AC replacement permits in Lake Mary and Heathrow

It depends on the address, not the mailing city. If your house is inside the City of Lake Mary corporate limits, the mechanical permit is issued by the City of Lake Mary Building Division at 911 Wallace Court and the fee is 0.75% of the documented mechanical valuation with a $35 minimum. If your house is in Heathrow, Heathrow Woods or another unincorporated pocket with a Lake Mary 32746 address, it is issued by the Seminole County Building Division at 1101 E. First Street in Sanford. Both require a permit for a split-system changeout.

The split

One ZIP code, two building departments

45,828residents in ZIP 32746 at the 2020 census
16,798residents in the City of Lake Mary at the same census
~2,200homes in Heathrow, an unincorporated CDP founded in 1985
~30sub-developments inside Heathrow, each setting its own HOA rules

Roughly two thirds of the people with a Lake Mary mailing address live outside the city. That is not a technicality for an air-conditioning job: it decides which portal the permit is filed in, which fee schedule applies, which inspector shows up and which scheduling deadline you are working to.

If a contractor quotes you a Lake Mary permit for a Heathrow house, they have not checked the address — and it is the same carelessness that skips the load calculation.

If the address is inside the city limits

City of Lake Mary Building Division

911 Wallace Court, Lake Mary, FL 32746. Permits 407-585-1441. Submittals go through the city’s own ePlan “GoPost” portal, not the county’s.

Mechanical permit fee for an alteration or repair — which is what a changeout is — is 0.75% of the documented mechanical valuation, $35 minimum. On a $9,000 changeout that is about $68. Inspections must be booked by 2:00 pm for the next business day. The city enforces the 2023 Florida Building Code, 8th Edition, and the 2020 NEC.

If the address is unincorporated

Seminole County Building Division

This is the desk for Heathrow, Heathrow Woods and the other unincorporated pockets that carry a Lake Mary 32746 mailing address. The county does not publish a residential mechanical permit fee schedule we could verify, so we do not quote one.

CommunityBuiltWhy it matters for a changeout
Heathrow1985–2017Unincorporated CDP. Roughly 2,200 homes across about 30 sub-developments, each with its own or a shared HOA. Founded 1985, so the gated core is now 25–40 years old.
Heathrow Woods1990–2007Gated estate section inside Heathrow. Homes run 4,147–7,240 sq ft, so two or three air handlers on one house is normal here and a single-tonnage quote is a red flag.
Grande Oaks at Heathrow2007–2019338 townhomes, 1,962–2,365 sq ft. The newest Heathrow-area stock — original equipment is 7 to 19 years old, which is the repair-or-replace window rather than past it.

Heathrow and Heathrow Woods are confirmed unincorporated. Seminole County’s permit portal describes itself as covering unincorporated Seminole County, and Heathrow is an unincorporated census-designated place. Check your own address against the City’s “Do I Live in the City of Lake Mary” map, or ask us and we will look it up before you request a quote.

What the city inspection actually is

The City of Lake Mary publishes fifteen mechanical inspection codes, M401 through M415. The ones a homeowner will see on a straightforward changeout are:

  • M412 Final Mechanical — the inspection that closes the permit.
  • M413 refrigerant piping test — if the line set is replaced rather than reused.
  • M401 Rough Mechanical and M402–M404 HVAC duct work — if duct work is part of the job.

Inspections must be scheduled by 2:00 pm for the next business day. The city enforces the 2023 Florida Building Code, 8th Edition, and the 2020 NEC as of 31 December 2023. Contractors submit their state licence, workers’ compensation and general liability insurance to the city, with the City of Lake Mary at 911 Wallace Court named as certificate holder.

Do not let the permit stay open. A permit that is never closed out is the version of unpermitted work that surfaces at closing, when it is somebody else’s lawyer asking about it.

The $7,500 exemption does not apply to your changeout

A residential air-conditioning changeout always requires a building permit in Florida. There is no dollar-amount exemption. Florida’s new permit exemption for single-family work valued under $7,500, created by HB 803 (2026), ch. 2026-63, and effective 1 July 2026, expressly does not apply to “any electrical, plumbing, structural, mechanical, or gas work” — s. 553.79(1)(g)2.b., Fla. Stat. A changeout is both mechanical and electrical work, so it is excluded twice over. The baseline requirement in s. 553.79(1)(a) continues to control.

One thing HB 803 did give you: since 1 July 2026 a local government must approve, approve with conditions, or deny a mechanical permit on an existing single-family home within 5 business days of a complete and sufficient application — but only where the value of the work is under $15,000 and the applicant uses the local government plans reviewer (s. 553.792(1)(a)1., Fla. Stat.). Larger Lake Mary replacements fall into a longer tier of the same statute, so treat the five days as conditional, not as a promise.

A separate provision is often credited to HB 803 and should not be. An HVAC replacement counts as a single-trade inspection under s. 553.791(1)(r), the private-provider statute, which predates HB 803 and traces to ch. 2024-191. It is an inspection category, not a permit category: it lets the owner, or the owner’s contractor with explicit written authorisation, hire a licensed private provider to do the plans review or inspection instead of waiting on the building department. The permit is still required.

The other exemption you will find online is a Miami-Dade local rule for like-for-like changeouts. It is a Miami-Dade rule. It does not apply in Seminole County.

And while we are correcting things people repeat: Seminole County is not in the High-Velocity Hurricane Zone. Under the 2023 Florida Building Code, Residential, R202, the HVHZ is Broward and Miami-Dade counties only. A contractor charging you an HVHZ premium in Lake Mary is charging you for a jurisdiction you are not in.

Permit questions

Do You Need A Permit To Replace Ac In Florida?

Yes — and the $7,500 exemption you read about excludes mechanical work.

What Happens if You Don’t Get a Permit To Replace Your AC in Florida?

Never inspected, surfaces at closing, and it can reach your warranty.

Do I need a licensed HVAC contractor for AC repair in Florida?

Class A, Class B, CAC versus RAC — and how to check a number.

The question, in the wording people ask it

Do You Need A Permit To Replace Ac In Florida?

Yes. A residential air-conditioning changeout always requires a building permit in Florida, and there is no dollar-amount exemption. Florida Building Code 105.2 lists the mechanical work that is exempt — portable and window units, portable evaporative coolers, self-contained refrigeration systems with 10 lb or less of refrigerant driven by motors of 1 hp or less, and replacement of parts that does not alter the equipment's approval. A residential split-system changeout is none of those. The new permit exemption for single-family work valued under $7,500, created by HB 803 (2026) and effective 1 July 2026, does not help either: it expressly does not apply to any electrical, plumbing, structural, mechanical, or gas work under s. 553.79(1)(g)2.b., Fla. Stat., and a changeout is both mechanical and electrical work. The like-for-like changeout exemption that circulates online is a Miami-Dade local rule and does not apply in Seminole County.
