AC permit timeline and inspections in Lake Mary, Florida

An AC changeout in Lake Mary is permitted work at any price: Florida’s new $7,500 exemption expressly excludes mechanical work. Inside the city, expect a 0.75%-of-valuation fee, an M412 final mechanical inspection, and inspections booked by 2:00 pm for the next business day.

What HB 803 did and did not do

Florida’s permit exemption for single-family work valued under $7,500, created by CS/CS/HB 803 (2026), ch. 2026-63, signed 6 May 2026 and effective 1 July 2026, does not apply to an air-conditioning changeout. It expressly does not apply to “any electrical, plumbing, structural, mechanical, or gas work” under s. 553.79(1)(g)2.b., Fla. Stat., and a changeout is both mechanical and electrical work. There is no dollar-amount exemption for a residential changeout in Florida.

What HB 803 did give you is a clock. Since 1 July 2026 s. 553.792(1)(a)1., Fla. Stat. requires a local government to approve, approve with conditions or deny a single-family residential permit application within five business days where the value of the work is under $15,000 and the applicant uses the local government’s own plans reviewer. A larger Lake Mary replacement can exceed $15,000, and then a longer tier of the same statute applies instead — so the five days is a condition, not a promise.

One thing is regularly credited to HB 803 and should not be. An HVAC replacement counts as a single-trade inspection under s. 553.791(1)(r), Fla. Stat., which is the private-provider statute and predates HB 803. It is an inspection category, not a permit category, and it is what makes a private provider an option in place of the jurisdiction’s own inspector.

The Notice of Commencement threshold has moved

Older contractor guidance still says a Notice of Commencement is required above $7,500 for dedicated HVAC work. Florida Statute 713.135 now exempts a direct contract to repair or replace an existing heating or air-conditioning system in an amount less than $15,000.

Practically: on a $10,000 changeout a homeowner working from an out-of-date FAQ will expect to record and post a Notice of Commencement the statute no longer requires. The statute governs. Ask which document your contractor is working from before the contract is written.

Which inspections a Lake Mary changeout actually gets

  • M412 Final Mechanical. The inspection every changeout inside the city gets.
  • M413 refrigerant piping test. Called when the line set is replaced — which, on an R-410A-to-R-454B changeout, it often is.
  • M401 Rough Mechanical and M402–M404 HVAC duct work. In play when ductwork is part of the job rather than just the equipment.
  • The City of Lake Mary publishes 15 mechanical inspection codes, M401 to M415, so you can read the schedule yourself rather than take a contractor’s word for what is being called.
  • Scheduling: city inspections must be booked by 2:00 pm for the next business day. Lake Mary enforces the 2023 Florida Building Code, 8th Edition, and the 2020 NEC.

The City of Lake Mary charges 0.75% of the documented mechanical valuation for an alteration or repair — which is what a changeout is — with a $35 minimum. That is the city’s figure, not ours, and it changes without notice. On a $9,000 changeout that is about $68.

Anchorage, clearances, and one thing that does not apply here

Seminole County is not in the High-Velocity Hurricane Zone. The HVHZ is Broward and Miami-Dade counties only under the 2023 Florida Building Code, Residential, Section R202, so Miami-Dade NOA product approval and the HVHZ chapters do not apply to a Lake Mary condenser pad. A competitor site in this market gets that wrong.

The pad and the equipment still have to meet the Florida Building Code and ASCE 7 wind loads, and the inspector will still look at the disconnect, the condensate termination, the secondary drain and float switch, and clearances from the property line and openings. In a gated Heathrow sub-development the association’s screening rules can constrain the location before the inspector ever sees it. What an association may and may not require ›
